General terms and conditions of business
1. Validity
The following general terms and conditions of participation apply to all offers, contracts and services of Anke Bartlewski (hereinafter referred to as: the organizer).
2. Services
2.1 The courses/events (hereinafter referred to as "courses") will take place at the times and locations specified in the registration. However, the organizer reserves the right to change times and locations if necessary.
2.2 Registration for the courses is binding for the participant. Transferring to a different course is only possible before the course begins, provided a suitable place is available. Missed sessions cannot be made up.
2.3 In the event of illness or urgent impediment of a course instructor, the organizer is entitled to provide a suitable substitute.
2.4 Every participant is subject to the house rules and must follow the instructions of the course instructor and the house staff.
2.5 Participants who violate common decency, sportsmanship, house rules, or business regulations may be excluded from the course without entitlement to a refund of the course fee.
2.6 By concluding the contract, the participant or their legal guardian confirms that there are no serious illnesses, such as heart defects, eardrum damage and infectious diseases, etc.
3. Course fee
3.1 The course participant must pay the agreed course fee before the start of the course.
3.2 The right to payment also exists in the event of default of acceptance, § 615 BGB. This means that the course fee must generally be paid in full by the course participant even if the participant does not attend the course, only attends part of it, or discontinues the course. The course fee is generally not refundable.
3.3 This does not apply if the course participant notifies the organizer of their non-attendance at least two weeks before the course begins and the vacated place can be filled by another participant. In this case, the course participant has a Administrative fee of €20.00 per course to be paid.
3.4 If a course cannot be held by the organizer, or has to be cancelled, the fee paid will be refunded proportionally.
4. Liability
4.1 Participation is at the participant's own risk.
4.2 The organizer is liable for property damage only in cases of intent or gross negligence. This also applies to actions attributable to the organizer's agents and any personal liability they may have for damages.
4.3 The organizer is not liable for class cancellations due to force majeure.
5. Final Provisions
5.1 All amendments and additions to contractual agreements, including these terms and conditions of participation, must be in writing. This also applies to any waiver of the written form requirement. Any further statutory form requirements remain unaffected. No oral side agreements will be made.
5.2 Should individual provisions of these terms and conditions of participation and/or other agreements between the contracting parties be or become wholly or partially invalid or unenforceable, or should the party agreements contain a formal defect or a gap, the legal validity of the remaining provisions shall remain unaffected. In place of the invalid provision, a valid provision shall be deemed agreed upon which most closely approximates the intent of the parties; the same applies in the case of a gap.
5.3 The contract concluded with the contractual partner, as well as these general terms and conditions of participation and all rights and obligations arising therefrom, are subject to the law of the Federal Republic of Germany.
The exclusive place of jurisdiction for all legal disputes arising from or in connection with the contracts concluded between the parties is Stuttgart. This also applies to disputes concerning the legal validity of the contract and its legal enforceability.
The term "organizer" is synonymous with Anke Bartlewski. The word "courses" is synonymous with courses, events, and services, as well as individual appointments of any kind.
